Please read these Terms of Service ("Terms") carefully before using the Platform. By accessing, browsing, or transacting on the Platform, you agree to be bound by these Terms, our Privacy Policy, and our Return & Refund Policy. If you do not agree, you must not use the Platform.

1. About These Terms

These Terms constitute a legally binding agreement between you ("User", "you", "your") and Six Ventures ("we", "us", "our"), operating the e-commerce platform and website at www.feray.in under the brand Feray. These Terms, together with our Privacy Policy and Return & Refund Policy, govern your use of the Platform and any transactions conducted through it.

2. Eligibility

To use the Platform and place orders, you must:

Be at least 18 years of age, or have the consent of a parent or legal guardian
Be legally competent to enter into a binding contract under the Indian Law
Not be barred from receiving services under applicable Indian law

By using the Platform, you represent and warrant that you meet these eligibility requirements. We reserve the right to suspend or terminate accounts where eligibility requirements are not met.

3. Account Registration

Certain features of the Platform require you to create an account. When registering, you agree to:

Provide accurate, current, and complete information
Maintain and promptly update your account information
Keep your login credentials confidential and not share them with any third party
Notify us immediately at contactus@feray.in if you suspect unauthorised access to your account
Not transfer, sell, assign, or license your account to any other person

You are solely responsible for all activity that occurs under your account. Six Ventures shall not be liable for any loss or damage arising from your failure to maintain the security of your account credentials.

4. Products and Listings

We take reasonable care to ensure that product descriptions, images, pricing, and other details displayed on the Platform are accurate. However:

Product images are for illustrative purposes and may vary slightly from the physical product due to lighting, screen calibration, device configuration, and photography.
We reserve the right to modify, discontinue, or withdraw any product at any time without prior notice
In the event of a pricing or description error, we reserve the right to cancel the affected order and issue a full refund, with prior notice to you
We do not warrant that the quality of any products or services purchased will meet your expectations beyond what is described on the Platform

All products listed on the Platform are subject to availability. We do not guarantee continuous availability of any listed product.

5. Pricing and Payments

All prices displayed on the Platform are in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. Prices displayed do not include shipping charges unless expressly stated.

We accept payments through the methods listed at checkout, including credit/debit cards, UPI, net banking, and other digital payment instruments. All payment transactions are processed through secure, third-party payment gateways. We do not store your complete payment card information on our servers.

You represent and warrant that: (i) any payment information you provide is true, correct, and complete; (ii) you are duly authorised to use the selected payment method; and (iii) charges incurred will be honoured by your payment provider.

We reserve the right to revise prices at any time. The price applicable to your order is the price displayed at the time of checkout and confirmed in your Order Confirmation. In the event of a failed or declined payment, your order will not be processed.

6. Order Placement and Confirmation

Placing an order on the Platform constitutes an offer to purchase the selected product(s) at the stated price. A binding contract is formed only upon our issuance of an Order Confirmation to your registered email address. We must receive and process your payment before your order is accepted.

Please review your order carefully before submitting. We may be unable to accommodate cancellation requests once an order is accepted.

We reserve the right to refuse or cancel any order at our discretion, including in cases of:

Product unavailability
Errors in pricing or product description
Suspicion of fraudulent or unauthorised activity
Non-delivery due to incorrect address or repeated failed delivery attempts

In the event of cancellation, any amount paid will be refunded in full to the original payment method. You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

7. Shipping and Delivery

We ship to addresses within India. Estimated delivery timelines are provided at checkout and in your Order Confirmation. These are estimates only and are subject to variation due to courier delays, force majeure events, or circumstances beyond our control.

Risk of loss and title to products passes to you upon delivery to the shipping address provided by you. We are not responsible for delays or non-delivery arising from incorrect or incomplete addresses. For queries regarding your shipment, please contact us at contactus@feray.in.

8. Returns, Refunds, and Cancellations

Returns, refunds, and cancellations are governed by our Return & Refund Policy, which forms part of these Terms. Key terms include:

A 15-day return window from the date of delivery, subject to eligibility conditions
Engraved and personalised products are not eligible for return
Refunds are processed to the original payment method within 10 business days of return approval
Orders may be cancelled within 14 days of receipt under the applicable cooling-off period

9. Warranties and Product Authenticity

All products sold on the Platform are genuine and sourced directly by Six Ventures. We warrant that products are free from material defects at the time of delivery. This warranty does not cover:

Normal wear and tear
Damage caused by misuse, improper handling, or alterations by unauthorised parties
Damage arising after delivery due to causes beyond our control

If you receive a defective or incorrect product, please contact us immediately at contactus@feray.in and we will remedy the issue in accordance with our Return & Refund Policy.

10. Disclaimer of Warranties

TO THE EXTENT PERMITTED UNDER APPLICABLE INDIAN LAW, THE PLATFORM AND ALL PRODUCTS OFFERED THROUGH IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY REPRESENTATION, WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, BEYOND THOSE REQUIRED UNDER APPLICABLE LAW. WE DO NOT GUARANTEE THAT USE OF THE PLATFORM WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

11. Intellectual Property

All content on the Platform, including but not limited to the brand name Feray, logos, product designs, photographs, text, graphics, and software, is the exclusive intellectual property of Six Ventures or its licensors, and is protected under applicable Indian laws.

You may not reproduce, copy, distribute, republish, display, or commercially exploit any content from the Platform without our prior written consent. Any unauthorised use may result in legal action.

12. Feedback and User Content

If you submit, upload, post, or otherwise transmit any ideas, suggestions, feedback, reviews, or other content ("Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute, and display such Feedback for any purpose, including operating and improving the Platform.

You represent and warrant that: (i) you own or have all necessary rights to all Feedback submitted; (ii) your Feedback is accurate and does not infringe any third-party rights; and (iii) your Feedback complies with these Terms and applicable law.

We reserve the right to remove any Feedback that we determine, in our sole discretion, to be unlawful, offensive, defamatory, or otherwise objectionable.

13. Third-Party Links and Services

The Platform may contain links to or integrations with third-party websites or services. We are not responsible for the content, accuracy, or practices of any third-party sites. If you access these links, you do so at your own risk and should review the relevant third party's terms and policies.

We are not liable for any harm or damages related to your access of third-party websites or your use of any products, services, or content offered by third parties.

14. Automated Agents and Bots

This clause applies if you use, allow, enable, or deploy any automated software, bot, scraper, crawler, or AI-powered agent ("Agent") to access, use, or interact with the Platform.

No Agent may access or interact with the Platform unless it at all times: (i) identifies itself clearly in HTTP/HTTPS requests; (ii) does not mimic human behaviour or circumvent CAPTCHAs or other security measures; (iii) responds truthfully to any prompt seeking to determine if interactions are from a human or computer; and (iv) does not circumvent any measures intended to block or limit automated access.

We reserve the right to restrict or block automated access to the Platform at any time. Use of Agents that violate these requirements constitutes a prohibited use and may result in account termination and legal action.

15. Prohibited Conduct

You agree not to:

Use the Platform for any unlawful, fraudulent, or abusive purpose
Attempt to gain unauthorised access to any part of the Platform or its systems
Introduce malware, viruses, or other harmful code to the Platform
Make false or misleading representations in connection with any transaction
Engage in price manipulation, fake reviews, or any other unfair trade practice
Resell or commercially exploit products purchased on the Platform without authorisation
Collect or track the personal information of other users
Transmit any unsolicited advertising or promotional material (spam)
Impersonate any person or entity, or falsely represent your affiliation with any person or entity

We reserve the right to suspend or permanently terminate accounts involved in prohibited conduct and to pursue appropriate legal remedies.

16. Limitation of Liability

To the maximum extent permitted under applicable Indian law:

Six Ventures shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform
Our aggregate liability for any claim arising from a transaction shall not exceed the value of the order in respect of which the claim arises
We are not responsible for delays, losses, or damages arising from events beyond our reasonable control, including natural disasters, internet outages, strikes, or government actions

17. Indemnification

You agree to indemnify, defend, and hold harmless Six Ventures, its affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims, including reasonable legal fees, arising out of: (1) your breach of these Terms; (2) your violation of any applicable law or the rights of a third party; or (3) your access to and use of the Platform.

We will notify you of any indemnifiable claim promptly, provided that a failure to promptly notify will not relieve you of your obligations unless you are materially prejudiced by such failure. We may, at our discretion, control the defence and settlement of such claim at your expense, but will not settle any claim that imposes non-monetary obligations on you without your prior written consent.

All grievances will be acknowledged within 48 hours and resolved within one/two month of receipt.

19. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of India.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform shall first be attempted to be resolved through good-faith negotiation between the parties. If unresolved within 30 days, the dispute shall be subject to the exclusive jurisdiction of the competent courts in Bangalore, Karnataka, India.

20. Privacy and Data Protection

All personal information collected through the Platform is subject to our Privacy Policy, which forms part of these Terms. By using the Platform, you acknowledge that you have read and understood our Privacy Policy.

We process personal data in accordance with Reasonable Security Practices and Procedures and Sensitive Personal Data or Information and such other applicable data protection laws as may be in force from time to time.

21. Amendments to These Terms

We reserve the right to amend these Terms at any time. Material changes will be communicated via the Platform. Continued use of the Platform after the effective date of any amendment constitutes your acceptance of the revised Terms.

22. Termination

We may terminate this agreement or your access to the Platform (or any part thereof) in our sole discretion at any time, with or without notice, in the event of breach of these Terms or on account of fraudulent or unlawful conduct. You will remain liable for all amounts due up to and including the date of termination.

The following sections will continue to apply after termination: Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, and any other provisions that by their nature should survive termination.

23. Miscellaneous

Severability: If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be severable and shall not affect the validity of the remaining provisions.

Waiver: Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Entire Agreement: These Terms, together with our Privacy Policy and Return & Refund Policy, constitute the entire agreement between you and us regarding your use of the Platform, and supersede all prior agreements.

Assignment: You may not transfer or assign your rights or obligations under these Terms without our prior written consent. Six Ventures may transfer or assign these Terms and its rights and obligations without consent.

Headings: Section headings are for convenience only and shall not affect the interpretation of these Terms.
